We have heard the learned Advocate for the petitioners for a while. It appears that even after granting liberty by order dated 25th August 2025 and filing of additional affidavit by petitioner No.1 alone, there are many documents which are necessary. The main grievance was in respect of the advertisement that management had issued for the appointment as Shikshan Sevak and Assistant Teachers. In pursuant to that advertisement no appointments have been done. The petitioners are claiming that they were already in service with the same

wp-6738.25 school. It was on temporary basis. Then the prayer clause says that they should be regularized on the granted posts as per the provisions of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Act.

In view of the fact that all the documents have not been filed and even the pleadings are lacking; when it is pointed out, the learned Advocate for the petitioners seeks withdrawal of the Petition with liberty to file an appropriate Petition with all the necessary documents.

Here it appears that the defect was due to non collecting of some documents and according to the learned Advocate for the petitioners, the management is not supplying those documents to the petitioners. Under such circumstance, when we are to deliver the justice, we must give an opportunity to the petitioners and therefore, we allow the petitioners to withdraw the Writ Petition with liberty to file appropriate fresh Petition by collecting documents.
