1] Heard learned counsel for the applicant and the learned APP for the respondent.
2] The applicant has been charged for the offence punishable u/s 420, 468 and 471 of the Indian Penal Code. It is the allegation of the respondent that the applicant has posed the signature of the then Block Development
- 2 - Officer, who had already died. During the pendency of the anticipatory bail application before the learned Additional Sessions Judge, Gangakhed, the applicant was on ad-interim anticipatory bail till its rejection on 6.5.2016.
3] During the course of the arguments, the learned APP has argued that the custody of the applicant is required for the purpose of interrogation and further investigation. The learned APP further states that there are strong suspicious circumstances appearing against the applicant and he must have signed the relevant documents before submitting the same to the authorities. 4] During the course of the arguments, the learned counsel appearing for the applicant, on instructions, states that the applicant is ready to cooperate with the investigation and also ready to give his specimen handwriting and signature before the Investigating Officer.
5] In view of the statement made by the learned counsel for the applicant, I am of the opinion that no custody of the applicant is required for the purpose of investigation.
- 3 - 6] In the event of arrest of the applicant, he shall be released on furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount. The applicant is directed to attend the concerned Police Station on every Sunday at 11-00 a.m., till filing of the charge-sheet. The applicant shall not tamper with the evidence of the prosecution in any way and shall cooperate with the investigation.
7] The application is disposed of accordingly.
