Having heard the Petitioner's Advocate, we do not think that the High Court should issue directions to the authorities so as to confer on the Petitioner any registration or recognition which would enable the Petitioner's members to draw benefits available under the Government Resolution dated 30.11.2011, copy of which is at page 59 of the petition paper book.

That resolution is unique in the sense that if the students who have participated at State, National or International level tournament or programme in sports in addition to their studies, then, they should be encouraged by grant of 25 increased marks. For claiming such benefits or

*2* 2.wp.5851.14 advantage, we do not see that in and at every level if the organization like the Petitioner is functional that should be granted affiliation or registration or recognition. Eventually, individual members and their children are not adversely affected. If they can independently prove that they have participated in any tournament and covered by the said Government Resolution, then, they can seek benefits in terms thereof. For those benefits to be claimed such as additional marks, it is not necessary that the Petitioner should be affiliated.

In these circumstances we are of the opinion that the petition has no merit. The Writ Petition is dismissed. kps (MANGESH S. PATIL, J.) (S.C. DHARMADHIKARI, J.)
