The informant alleged that on 18.03.2016 present applicant/accused and another accused have assaulted him and snatched an amount of Rs.20,000/- and abused him on caste. Therefore, offence punishable under sections 392, 294, 323, 506(2) r/w 34 of the Indian Penal Code and sections 3 (1)(r) (s) & 3 (2) (5) of the Prevention of Atrocities Act is registered against present applicant and other accused vide Crime No.31 of 2016 with Basmath City Police Station. 3.

It is stated by learned Counsel for the applicant that present applicant has surrendered before the police and he has produced the amount of Rs.20,000/-, which is stated to

( 2 ) cria2753.16 be snatched from the victim and the amount came to be attached under panchanama. So, practically, the investigation in reference to present applicant is over.

Looking to the facts and circumstances of the case and the accused is in jail since 10.05.2016, this Court is of the opinion that the accused can be released on bail. Hence, following order :- i.

The Criminal Application is allowed.

ii.

The applicant/accused - Mahesh s/o. Laxman Narwade shall be enlarged on bail in connection with Crime No.31 of 2016 registered with Basmath City Police Station, for the offence punishable under section 392, 294, 323, 506(2) r/w 34 of the Indian Penal Code and sections 3 (1)(r)(s) & 3 (2)

(5) of the Prevention of Atrocities Act, on execution of P.R. Bond of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in like amount. He is further directed to attend the concerned police station once in a week i.e. on Sunday between 12.00 noon to 02.00 p.m. till filing of charge-sheet.

The applicant shall not tamper with the evidence of prosecution in any manner and shall cooperate with further investigation, if any. 5.

The Criminal Application is accordingly allowed and disposed of.
