The Applicant prays for condonation of delay of 157 days caused in filing the Second Appeal.

The learned Advocate for the Respondents strenuously opposed the application. However, in the alternative, it is submitted that in the event of this Court allowing this application, the costs may be imposed and the said amount be donated to the Advocates Association of Bombay High Court, Bench at Aurangabad.

Considering the above and for the reasons set out in the Civil Application, the same is allowed and delay of 157 days is condoned subject to costs of Rs.2000/- (Rupees Two Thousand), which the Applicant

*2* 21ca12433o17 shall deposit with the Advocates Association of Bombay High Court, Bench at Aurangabad on or before 09.02.2018, failing which, this order shall stand recalled and the Civil Application shall stand rejected. After the costs are deposited and all office objections are removed, the Second Appeal shall be registered and listed for admission on 14.02.2018.
