The learned counsel for the applicant seeks permission to withdraw the present application with request that the appeal be heard. Since the paper book is not prepared, the R & P be sent back to the concerned Sessions Court for preparation of paper book. The concerned court shall endevour to prepare the paper book as expeditiously as possible and shall re-submit the R & P alongwith paper book to this court.

If the appeal is not heard within one year, the applicant is at liberty to file fresh application.
