Heard learned APP for the applicant-State. Perused the application. 2.

Present application is filed by the applicant - State for condonation of (16) days delay caused in preferring the application seeking leave under section 378(3) of the Criminal Procedure Code to present the appeal against the judgment and order of acquittal of respondent - accused passed in Special Case(PCA) No. 5 of 2010, by learned Additional Sessions Judge-3, Jalna for the offence punishable under sections 13(1)(e), 13(2) read with section 13(1) (e) of the Prevention of Corruption Act, 1988 and under section 109 of the Indian Penal Code read with section 13(1) (e) of the Prevention of Corruption Act.

For the reasons stated in the application, the same is allowed in terms of prayer clause"B" and the same stands disposed of. Delay stands condoned. Registry to take requisite steps for further process. 4.

List the Criminal Application No. 2757 of 2016 for hearing on 18-07-2017.
