The applicant is seeking pre-arrest bail in

2 Cri. Appln. 2762-2016 Crime no. 0191 of 2016 registered at MIDC Waluj Police Station, Dist. Aurangabad for an alleged incident dated 19/4/2016 for which crime came to registered on 22/4/2016, pursuant to the complaint of the same.

Apart from delay in lodging the FIR, if the contents of the FIR are perused, the only ground for impleading the applicant in the crime in question, is registration of earlier crime no.0146 of 2016 for the offences punishable under section 354, 452 of the Indian Penal Code.

Upon perusal of the investigation papers, it depicts that the deceased - Subhash has asked the complainant to go to her parental house and then has committed the suicide. There is hardly any material on record to connect the present applicant in the crime in question apart from the earlier crime no.0146 of 2016, in which the applicant is already released.

In view thereof, the Application stands allowed.

In the event of the arrest of the applicant in Crime no.0191 of 2016 registered with MIDC Waluj Police Station, Dist. Aurangabad for the offence punishable under section 306 of the Indian Penal Code, he be released on bail upon his executing P.R. bond in the sum of Rs.15,000/- (Rs. Fifteen Thousand) with one surety in the like amount. 7.

Applicant shall attend the concerned Police Station on 13th and 14th June, 2016 between 10 am and 12 noon and thereafter as and when called by the Investigating Officer.

Criminal Application stands disposed of accordingly.
