BENCH AT AURANGABAD 29 WRIT PETITION NO.6733 OF 2020 NAVNATH SUDAM PANSARE AND ANOTHER
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr A. S. Bajaj, Advocate for petitioners;
Mr S. B. Pulkundwar, A.G.P. for respondent Nos.1 & 2/State; Mr K. N. Shermale, Advocate for respondent Nos.3(i) to 3(vi) CORAM : RAVINDRA V. GHUGE AND AVINASH G. GHAROTE, JJ.
DATE : 21st June, 2021 PER COURT:
1.
The learned Advocate for the petitioners submits that an award dated 31/05/2021 is delivered and any grievance that the petitioners may carry against the award, would be voiced only through proceedings under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short "the 2013 Act"). It is also submitted that an application has already been tendered, albeit under Section 18 of the Old Act, which should be treated as being under Section 64 of the
6733.20wp (2) 2013 Act, before the competent authority. Hence, this petition is rendered infructuous.
2.
In view of the above, this petition is disposed off. 3.
We make it clear that we have not expressed any opinion on the grievance of the parties in this petition. We are sure that the authority concerned will comply with the provisions of the 2013 Act. (AVINASH G. GHAROTE, J.) (RAVINDRA V. GHUGE, J.) sjk
