Heard learned counsel for respective sides.

The present petition is arising out of the order dated 26.04.2023 passed by the learned Sub-Divisional Officer, Beed in ROR Appeal No.32 of 2013.

The learned A.G.P has raised an objection about the maintainability of the petition on the ground that the order passed by the Sub-Divisional Officer (S.D.O.) is appealable before the Additional Collector under Section 247 of the Maharashtra Land Revenue Code, 1966.

In view thereof, the Writ Petition is disposed of as not maintainable.

5.

The petitioner is at liberty to file an appropriate appeal before

2 970.doc the Additional Collector within a period of eight weeks from today. If the petitioner files an affidavit in the aforesaid period, then the Additional Collector shall decide the same within a period of six months thereafter.

6.

Delay caused in prosecuting the present petition shall be taken into consideration by the appellate authority while considering an application for condonation of delay.
