After arguing the application for some time, learned Counsel for the applicant submits that in view of provisions of Section 437 (6) of the Code of Criminal Procedure, the applicant would approach the learned Magistrate for enlarging him on bail, as the trial has not commenced within the period specified in said provision.

The application is permitted to be withdrawn with liberty to approach the learned Magistrate for being released, in view of provisions of Section 437 (6) of the Code of Criminal Procedure.
