Learned counsel for the applicant submits that being aggrieved by the judgment and award passed by the Reference court, the State has also preferred appeal. Learned counsel submits that delay caused in filing the appeal is not intentional one. Learned A.G.P. for the respondent State has strongly resisted the application on the ground that delay has not been explained satisfactorily. However, considering the fact that the State has also filed appeal against the judgment and award passed by the Reference Court, delay caused in filing the present appeal is hereby condoned. Civil application is allowed and disposed of.
