Heard learned counsel for the applicant, learned APP for the State and learned counsel for the victim. 2.

The applicant is seeking bail in Crime No.90 of 2023 registered with Majalgaon Rural Police Station, District Beed for the offence punishable under Section 354(A)(1)(i), 504, 506 r/w 34 of the Indian Penal Code, Section 8 of Protection of Children From Sexual Offences Act and Section 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 3.

It is a matter of dispute whether the applicant hug the victim out of love or lust. They are neighbors. The investigation has been completed. Nothing is to be recovered from the applicant. The apprehension of threat of the victim at the hands of the applicant may

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Bapu @ Bapurao Munjaba Satpute, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall not contact the victim or her parents and relatives till conclusion of the trial.

(iv) The applicant shall stay away for one month from his village from the date of his release.

(v) The Secretary, High Court Legal Services Sub-Committee, Aurangabad Bench do pay the fees of the appointed counsel for respondent no.2/victim as per schedule.
