CORAM:SMT. ANUJA PRABHUDESSAI & R.M. JOSHI, JJ DATE :JANUARY 10, 2023 PER COURT :

1.

By these Petitions, the Petitioners have sought to quash the R.C.C. No. 85/2020 pending on the file of learned JMFC, Ashti, arising from FIR No. 151/2020 & R.C.C. No. 82/2020 pending on the file of

learned JMFC, Aashti, arising from FIR No. 150/2020, both lodged before Police Station Aashti for the offences punishable under Sections 143, 147, 148, 149, 324, 323, 504, 506, 188, 269, 270 of the Indian Penal Code as well as under the provisions of Disaster Management Act and Bombay Police Act.

2.

Learned Counsel for the respective parties submit that parties have settled the dispute amicably. The injured persons in respective crimes have filed their affidavits confirming settlement and giving consent for quashing the subject FIRs.

3.

Learned APP states that the dispute is of personal nature and has no objection for quashing the proceedings in view of settlement arrived at between the parties.

4.

Having considered the nature of the accusations leveled by the parties against each other, and also considering that the parties have arrived at an amicable settlement, in our opinion, this is a fit case to exercise power under Section 482 of Cr.P.C. so as to enable the parties to put an end the acrimony and

maintain cordial relations. Under these circumstances, Petitions are allowed. Consequently, R.C.C. No. 85/2020 pending on the file of learned JMFC, Aashti arising out of FIR No. 151/2020, as well as charge-sheet no. 62/2020 & R.C.C. No. 82/2020, arising out of FIR No. 150/2020 as well as charge-sheet no. 56/2020, are quashed subject to cost of Rs. 5,000/- by the Petitioners in the respective Petitions to be paid to the High Court Bar Association Library, Aurangabad.
