This petition has been filed with the following prayer:
"(B) By issuing appropriate writ, order or direction, the Direction No.04/2013 issued by the respondent No.2, prohibiting separate re-evaluation facility for re-evaluation of the answer sheet of the students after declaration of result of the examination vide Clause No.6, so also circular dated 15/05/2013 issued by the Examination Controller of respondent No.2, which has intimated cancellation of provision for reevaluation of the answer sheets of the students who are enrolled with respondent No.2 University, may kindly
5653.16wp be quashed and set aside;"
The learned Counsel for the respondent No.2 has tendered across the Bar the copy of the judgment dated 26th September, 2013 delivered by the High Court of Bombay at the Principal Seat in Writ Petition No. 6158 of 2013 (Dr.Swapnil Deelip Dhake & Anr. Vs Maharashtra University of Health Sciences, Nasik & Ors.) with companion writ petitions and submits that there was identical challenge in the said writ petitions.
However, after considering the relevant direction, the ultimate conclusion reached by the High Court was that neither the syllabus nor the method of examination has been altered by the Direction No.4/2013.
In that view of the matter, since the subject matter of the writ petition is covered by the said pronouncement, this petition stands disposed of in the terms of reasons which are assigned in the aforesaid judgment in Writ Petition No. 6158/2013.
