Heard Mr. S.B.Ghatol Patil, learned counsel appearing for the applicant and Mr. A.G.Magare, learned A.P.P. for Respondent/State. .

The applicant has been convicted for the offence punishable u/s 307 of the Indian Penal Code and sentenced to suffer Simple Imprisonment for a period of five years and to pay fine of Rs. 5,000/- [Rupees Five Thousand]. He has been also convicted for the offence punishable u/s 354-A [1]

2 Cr.Apln. 2782.2016 in Cr.Appeal 332.2016.odt of the Indian Penal Code and sentenced to suffer Rigorous Imprisonment for a period of six months and to pay fine of Rs. 500/- [Rupees Five Hundred].

Considering the facts and circumstances of the case and the fact that the applicant has deposited fine amount before the trial Court, I am of the opinion that during the pendency of the appeal, the applicant can be enlarged on bail.

Hence, Criminal Application is allowed.

Applicant Kailas s/o Vishnu Kamble be released on bail on furnishing P.R. Bond of Rs. 15,000/- [Rupees Fifteen Thousand] with one surety in the like amount till the disposal of the Criminal Appeal.

Appeal 'admitted'.

Criminal Application stands disposed of.
