Heard the learned counsel for applicant and the learned APP. When this Court expressed disinclination to grant any relief to the applicant, the learned counsel for the applicant, on instructions, seeks leave to withdraw the application.

Leave granted. The bail application stands disposed of as withdrawn.

The applicant is addicted to the liquor. Prima-facie he is mentally ill as per Section 2(1)(s) of the Mental Healthcare Act, 2017. The jail authority concerned is directed to send him for medical examination through psychiatrist and if found that he is mentally ill, he be treated by a psychiatrist after a report confirms that his mental

914 BA.935.2025.odt illness is due to addiction of liquor, as per the directions given by this Court in Bail Application No.740 of 2025 (Pramod Wamanrao Dhule Vs. The State of Maharashtra and another) dated 25th September, 2025.

If the applicant recovers from the illness and thereafter, files an application for bail, the Trial Court may consider the same on its own merits.
