Having regard to the subject matter involved and the reasons given in the application, to which though there is only ostensible resistance, when veracity of averments is not in dispute, we deem it appropriate to allow the application, subject to costs of Rs.5000/- (Rupees five thousand). Civil Application is accordingly allowed in terms of prayer clauses A, B, C and D. Learned counsel for the respondents gracefully state that the amount of costs be paid to the High Court Legal Services Authority, Aurangabad. In the circumstances, the amount of costs be paid by the applicant to the High Court Legal Services Authority, Aurangabad and the receipt be produced in the file.
