Learned Advocates for the respective sides placed reliance upon the judgment of this Court dated 08/02/2013 in the matter of Jagannath s/o Anna Khakare and others Vs. The State of Maharashtra and others [2013(2) All MR 841 = 2013(7) BCR 311]. 2.

It is jointly submitted that in identical set of facts, the learned Division Bench has taken a view in paragraph No.22 and has negated the contentions put forth by the petitioners in the group of petitions. It is, therefore, jointly submitted that this petition can be disposed off in the light of the view taken by this Court in paragraph No.22 in the Jagannath Khakare case (supra).

Considering the above, this petition stands dismissed in the light of the observations of this Court in paragraph No.22 in the Jagannath Khakare case (supra).
