Present application has been filed for getting delay of 492 days condoned in filing first appeal. The applicants intend to challenge the judgment and award passed by the learned Commissioner for Workmen's Compensation and Judge, Labour Court, Aurangabad.

The application is objected by the learned Advocate representing respondent no.02 on the ground that the reasons stated in the application are not sufficient and reasonable.

Taking into consideration the fact that in

(Order) (2) C.A. No. 9565 of 2013 the appeal, as per the submissions on behalf of the applicants, narrow question is involved stating that the interest has not been awarded. Learned Advocate for the applicants submits that the applicants have received the principal amount.

Taking into consideration this narrow subject matter of the appeal and also the fact that the applicants are the legal representatives of the deceased employee, liberal approach is taken.

The delay stands condoned.

The application stands allowed and disposed of. Registry to verify and register the first appeal and place it for further consideration on 18th September 2019.
