Per Court :- Present Criminal Application is filed by the Applicant for grant of regular bail in connection with CR No. 4/2015 registered with Police Station, Taloda, Taluka - Taloda, District - Nandurbar for the offences punishable under Section/s. 306, 498(A), 323, 504 of the Indian Penal Code.
[2] Heard Mr. Ajaykumar G. Magare, learned counsel for the Applicant and Mr. A.S. Shinde, learned Additional Public Prosecutor for the Respondent - State of Maharashtra.
[3] According to the charge sheet, present Applicant, who is husband of deceased - Nirmalabai, used to take suspicion on her character and under the influence of liquor, he used to beat her and
2/2 cri.appln. 3006.15..sxw also used to cause ill-treatment, both physical and mental to Nirmalabai, therefore, on 15th January, 2015, according to the prosecution, she has poured kerosene on her person and set her ablaze. Due to burn injuries, she died on 25th January, 2015. [4] Investigation is over. Charge sheet is already filed in the court of law. Since 2nd March, 2015 present applicant is in jail. In that view of the matter, the Applicant can be released on bail. That leads me to pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) Applicant - ASHOK VAJU THAKARE shall be released on regular bail on he executing P.R. Bond of Rs. 10,000/- [Rs. Ten Thousand.] with one solvent surety in the like amount, in connection with CR No. 4/2015 registered with Police Station, Taloda, Taluka - Taloda, District - Nandurbar for the offences punishable under Section/s 306, 498(A), 323, 504 of the Indian Penal Code. (iii) Bail before trial court.
(iv) With this Criminal Application is allowed and same is disposed of, accordingly.
