PER COURT :

1) Heard the learned Counsel appearing for the petitioner and learned AGP appearing for the respondents. Perused the pleadings in the petition; annexures thereto and averments in the affidavit in reply filed by Respondent Nos. 1 and 2.

2) During the course of hearing, the learned Counsel appearing for the petitioner submits that the petitioner is fully qualified for appointment to the post of Divisional Godown Inspector, however, his application has not been considered by the respondents on merits.

3) Upon perusal of the averments made in the affidavit in reply and in particular para 16 thereof, a statement is made on behalf of the respondents that if required, the authority will consider the representation of the petitioner on merits.

4) In the light of the statements made in the affidavit in reply, we direct respondent Nos. 3 and 4

to consider the application/represention of the petitioner on merits as expeditiously as possible and preferably within a period of eight weeks from today and communicate the decision to the petitioner. 5) The petition stands disposed of on above terms.
