The petitioner is already protected under orders of this Court dated 09.08.2007 in Writ Petition No. 4339 of 2005. Said writ petition is still pending. Inspite of protection granted, the petitioner is placed on supernumerary post.

The order placing the petitioner on supernumerary post shall stand stayed during the hearing and pendency of the writ petition.

In view of the above order, we are not inclined to take cognizance of the contempt.

The respondents shall process the papers of the petitioner for grant of provisional pension subject to the decision in the writ petition.
