Advocate for Petitioner : Shri Momin Mustafa AGP for Respondents 1 & 2 : Shri Korde D.R.

...

CORAM : RAVINDRA V. GHUGE, J.

Dated: September 01, 2015 ...

PER COURT :- 1.

The petitioner is aggrieved by the document dated 19.2.2013. The petitioner has not challenged any order in this petition going by the prayers set out therein. In paragraph No.3, the petitioner has made a statement that he is challenging the rejection of the appeal by the respondent No.2 - Commissioner, through respondent No.3 - CEO, ZP, Osmanabad. 2.

I find that the appeal which is said to have been preferred by the petitioner on 28.11.2012 has not been decided by the purported order dated 19.3.2013. The document dated 19.3.2013 is the reply of respondent No.3 in the appeal in between the petitioner and respondent No.3. 3.

Learned AGP submits that in the event the appeal is pending, respondent No.2 shall decide the said appeal expeditiously. In the event the appeal is decided and the outcome of the appeal is not communicated to the petitioner, same will be done within three weeks from today. 4.

In the light of the above, this petition is disposed off. The competent authority from the office of the Divisional Commissioner, Aurangabad shall decide the appeal of the petitioner dated 28.11.2012 within eight weeks from today, after intimating the petitioner of the date of hearing and considering the submissions of the petitioner. akl/d
