Jayashri Tulshiram Chavan And Others v. The Manager Maharashtra State Electricity Distribution Company Limited Mumbai
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 5965 OF 2015 JAYASHRI TULSHIRAM CHAVAN AND OTHERS
VERSUS
THE MANAGER MAHARASHTRA STATE ELECTRICITY DISTRIBUTION COMPANY LIMITED MUMBAI ...
Advocate for Petitioners : Mr. Gore Ravindra Vitthal ...
CORAM
: S. V. GANGAPURWALA & V. K. JADHAV, JJ.
DATE :
17th June, 2015 PER COURT :
1. Mr. Gore, learned counsel for the petitioners submits that Clause 1 of the advertisement is not adhered. Marks obtained in SSC or equivalent examination have to be considered. The respondents have not considered the marks obtained by the petitioners in vocational course. According to the learned counsel, Clause 1 of the advertisement under the head 'Selection Procedure' itself is erroneous and against Article 14 of the Constitution of India.
2.
It is not disputed that the practitioners have participated in the selection process pursuant to the said advertisement. It is no where shown that the qualification possessed by the petitioners is equivalent to SSC or the same has been declared as equivalent to SCC. Be that as it may, once the petitioners have participated in the selection process and as the selection process has come to an end by way of declaration of selection list, it is not open for the petitioners to challenge the said advertisement. We could have considered the submissions of the learned counsel for the petitioners, had the petitioners challenged the advertisement before participation in the selection process itself. 3.
In the light of above, writ petition is disposed of. No costs. (V. K. JADHAV, J.) ( S. V. GANGAPURWALA, J. ) JPC 1/1
