Learned A.G.P. Points out that in view of the Government Resolution dated 12.04.2007, there is an alternate remedy available for redressal of grievance of the petitioner. As per clause 4 of the Government Resolution dated 12.04.2007, a remedy of tendering an appeal is provided as against order of termination and the appeal is maintainable before the Commissioner, Integrated Child Development Scheme.

Petitioner states that he would tender an appeal within a period of six weeks from today.

If the petitioner tenders an appeal within time stipulated as above, the appellate authority shall decide the appeal, as expeditiously as possible, preferably within a period of three months from the date of tendering an appeal. It would be

{2} wp566716.odt open for the petitioner to putforth all the contentions, raised in the instant petition, in the appeal, and it is made clear that pendency of instant petition would not come in the way of petitioner for pursuing remedy of appeal, as provided under the Government Resolution.
