Heard Mr. Bhokarikar, learned Advocate appearing for the applicants and Mr. Dande, learned Advocate appearing for respondent no.3/Acquiring Body.

Mr. Bhokarikar submits that in the matters arising out of same Award, earlier this Court permitted withdrawal of 50% amount deposited by the Acquiring Body. The same course may be followed in this case.

Mr. Dande, learned Advocate appearing for respondent no.3 do not dispute aforesaid position.

Considering submissions advanced, application is partly allowed. The applicants are permitted to withdraw 50% of the amount deposited in this Court subject to furnishing of undertaking to the satisfaction of Registrar (Judicial) of this Court. Balance amount be invested in Fixed Deposit in Nationalized Bank.
