Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.411 of 2023 registered with Pundliknagar Police Station, District Aurangabad for the offence punishable under Sections 302, 323, 324, 143, 148, 149, 109, 114 r/w 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act.

The applicant seeks bail on parity. The learned APP submits that the role attributed to the applicant is little bit different from the co-accused who have been granted bail. 4.

Perused the papers and the order granting bail to the other co-accused. It appears that the role attributed to the applicant is identical to the role attributed to the co-accused who have been

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Ganesh Sitaram Jadhav, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the trial on each and every date.

(c) The applicant shall not contact the witnesses in any mode or manner till conclusion of the trial.

(d) The applicant shall not enter the locality where the incident happened till conclusion of the trial. (e) The applicant shall furnish his address with mobile cell phone number and would not change it till conclusion of the trial.
