Dated : 30 January 2025 PER COURT :- Learned counsel for both sides submit that the matter is amicably settled. Learned counsel for the applicant has placed on record copies of receipts towards deposit of total amount of Rs.2,00,000/-. The same are taken on record and marked "X Collectively." Learned counsel for respondents seek permission to withdraw the amount so deposited, to which other side has no objection. Both the parties seek matter to be disposed off as settled. In view of the above, following order is passed :
969-CriRevn-158-2023 -2ORDER I) The judgment and order of conviction of the applicant and sentence imposed upon him in S.C.C. No.259/2009 by learned Judicial Magistrate First Class, Udgir dated 05.08.2019 and the judgment and order dated 02.05.2023 passed by learned Additional Sessions Judge, Udgir in Criminal Appeal No. 15/2019 confirming the conviction, are hereby set aside.
II) The applicant stands acquitted of the offence punishable under Section 138 of Negotiable Instruments Act. III) The bail bonds of the applicant are hereby discharged. IV) The respondent is permitted to withdraw the amount deposited by the applicant.
