DATED : 24.08.2016 PER COURT :- Learned counsel appearing for the petitioner submits that Arms Forces Tribunal is functioning at present in Mumbai, and therefore, he wish to prosecute the grievances raised in this petition before the said Tribunal. It is open for the petitioner to withdraw this petition and present the appropriate proceedings before the said Tribunal.

In that view of the matter, learned counsel appearing for the petitioner seeks liberty to withdraw the petition, with further liberty to take out appropriate proceedings before the Armed Forces Tribunal. Liberty granted as prayed for. The Petition is dismissed as withdrawn.

Needless to observe that the petitioner was prosecuting this Writ Petition for considerable time. Therefore, while considering the prayer for delay in filing the proceedings before the Tribunal, the Tribunal shall keep in view the time spent by the petitioner in prosecuting this petition.
