IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8577 OF 2018 GORAKH KISAN KALAPURE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Ms. A. S. Madake h/f Mr. Kale A. B. AGP for Respondent/s-State : Mr. S. B. Pulkundwar. ...

CORAM : S. G. MEHARE, AND SHAILESH P. BRAHME, JJ.

DATE : 05.02.2025 PER COURT :- 1.

Heard the respective learned counsels.

2.

A simple request of the petitioner is as per his calculation, he has completed ten years service making him entitled to the pension. Therefore, he made the representation to respondent No.2. Pursuant to the total period of his service, respondent No.2 did not consider his service of daily wager and expressed an opinion that he did not complete ten years service. Therefore, he is not entitled to pension. However, by letter dated 05.02.2015, respondent No.2 has forwarded his opinion to the Government. Since then, the Government did

930-WP.8577-18.odt not take any decision nor there was any communication between the Government and respondent No.2. We hope that the Government should at least take decision and communicate to the citizens, so they should be relieved. But, unfortunately this is not happening, unless the Court intervenes. The Government should be the best care taker of the citizens and prompt in attending their grievances. But, many reasons are given.

3.

Be that as it may, we dispose of this writ petition by directing the Government to take an appropriate decision on the application dated 05.02.2015 within one (1) month from the receipt of this order. That letter may be misplaced, so we direct respondent No.2 to forward one another copy to the Government within one (1) week from today.
