The learned Advocate for the petitioner places on record the judgment dated 24.8.2021 delivered by the learned Special Judge and Additional Sessions Judge, Jalna in Special Case (ACB) No.21 of 2018 by which the petitioner has been acquitted of the offence punishable under Section 7 and 13 (1) (d) read with 13 (2) of the Prevention of Corruption Act, 1988 (No.49 of 1988).

The learned Advocate for the management therefore submits that, by keeping all contentions of the litigating parties open in the

wp6196.19 (2) Departmental Enquiry, the Departmental Enquiry can be proceeded with in accordance with the procedure laid down in law and the Rules/Regulations applicable.

The learned Advocate for the petitioner submits that in the light of the above statement, the petition can be disposed off. 4.

In view of the above, this petition is disposed off. The Departmental Enquiry can proceed in terms of the charges leveled upon the petitioner and by following the procedure laid down in law. 5.
