Learned counsel for the petitioner states that liberty may be granted to him to approach the Court of Magistrate for making an application for further investigation under Section 173(8) of the Code of Criminal Procedure. He submits that he is not pressing this petition in view of this alternate remedy.

Permission is granted to withdraw this petition with aforesaid liberty. If any such application is preferred before the Magistrate, it shall be decided on its own merits in accordance with

( 2 ) law taking into account the material collected by the Investigating Agency and the grievance of the petitioner. With these observations the petition is disposed off.
