The alleged incident of assault ensued after a spat while playing cricket. After settling the quarrel when complainant was proceeding towards a temple at around 8.30 the applicant and the co-accused mounted assault on the complainant his wife and son Saurabh by inflicting the blows of wooden stick. The complainant would allege the applicant assaulted Saurabh by wooden stick. In so far as the injuries allegedly caused by the

(2) aba706.21 applicant, the learned Judge in paragraph No. 5 noted the injuries were simple injuries. There are no criminal antecedents against the applicant. In consideration of these facts, in my view the custodial interrogation of the applicant shall not further the case of the prosecution.

The application is allowed. In the event of arrest of the applicant in Crime No. 359 of 2021 registered with Taloda Police Station, Taloda, Dist. Nandurbar for the offences punishable under Sections 326, 324, 323, 427, 143, 147, 149, 504 and 506 of the Indian Penal Code , he shall be released on bail on executing bond in the sum of Rs. 20,000/- [Rupees Twenty Thousand] with one or more sureties in the like amount. The applicant shall report to the Investigation Officer on 16th, 23rd, 30th of July, 2021 and 6th August, 2021 between 11.00 to 01.00 pm and thereafter as and when called.
