Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.246 of 2022 registered with Himayatnagar Police Station, District Nanded for the offence punishable under Section 307, 341 of Indian Penal Code. 3.

It is a case of illicit relation of the injured with the wife of the applicant and out of that relation, the applicant got angry and the incident happened. It seems that the applicant was very much disturbed due to the relations kept by the injured with his wife. 4.

The injured has been discharged. Nothing is to be recovered from the applicant. Considering the facts of the case and particularly the mental condition of the applicant, the Court is of the view that he deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Prakash Bhagwan Solanke, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall not enter Himayatnagar for three months from the date of his release.

(iv) The applicant shall not contact the injured or any other witnesses till conclusion of the trial.
