This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0059/2022, registered with Mhaswad Police Station, District Nandurbar, for the offences punishable under Sections 376, 376(2)(n), 366, 506(2) read with 34 of the Indian Penal Code and under Sections 3, 25 of the Arms Act. 2.

Heard.

Perused the First Information Report (FIR) and the related police papers.

The learned Advocate for the applicant has placed on record certain photographs to indicate the applicant and the victim

(( 2 )) 62-BA-854-2022 to have been in emotional relationship. Even before the trial Court, the victim has filed affidavit and before this Court, as well. The victim is the adult woman.

It being a case of consensual relationship and the chargesheet has been filed, the application deserves to be allowed. Hence, following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0059/2022, registered with Mhaswad Police Station, District Nandurbar, for the offences punishable under Sections 376, 376(2)(n), 366, 506(2) read with 34 of the Indian Penal Code and under Sections 3, 25 of the Arms Act, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall not tamper with the prosecution evidence.
