DATED : 26 th June, 2015 PER COURT :- 1] This is an application for anticipatory bail filed by the applicant Kalpana Bangar apprehending her arrest in connection with Crime No. 97 of 2015, for the offences punishable under Sections 307 r/w 34 of the Indian Penal Code, registered with Police Station, Kaij, District Beed. 2] I have heard Shri S.S.Thombare, learned counsel for applicant and Shri V.H.Dighe, learned Additional Public Prosecutor.

3] The first information report is lodged by Kundlik, who himself is an injured. The first information report would reveal that on 30.4.2015 when he had been to his house, coaccused Namdeo, Arjun and Bhanudas along with the present applicant picked up a quarrel on account of money in respect of side wall. That time, according to the first information report, accused Namdeo Bangar gave a sword blow on his head; whereas the present applicant and Arjun gave the stick blow. It is reported that accused Namdeo and accused Arjun are arrested and they are already released on bail.

crap3046.15 4] The first information report shows that both Arjun and Kalpana have given stick blows. However, though injury certificate shows that there are two contusions, both are simple in nature.

5] In that view of the matter, custodial presence of the applicant, who is a lady, is not required. That leads me to pass the following order.

O R D E R

(i) In the event of arrest, in connection with Crime No. 97 of 2015, for the offences punishable under Sections 307 r/w 34 of the Indian Penal Code, registered with Police Station, Kaij, District Beed, the applicant be released on anticipatory bail on he executing P.R. bond in the sum of Rs.5,000/- with one solvent surety in the like amount.

(ii) Application is disposed of.
