Heard learned counsel for the petitioners, learned Government Pleader and the learned AGPs for the State.

The learned counsel for the petitioners submit that the Chief Executive Officer has not considered the documents submitted by the petitioners. False information is not given by the petitioners. The petitioners have been transferred on the ground of couple convenience.

We have heard the learned Government Pleader and the AGPs also. The finding is arrived at by the Chief Executive Officer about the

4 1069-wp-6395-19+group.doc claim made by the petitioners and the Chief Executive Officer has found the same to be false. The orders are passed under the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules.

The petitioners have remedy to file appeal under the provisions of Rule 13 and 14 of the Maharashtra Zilla Parishad District Services (Discipline and Appeal ) Rules, 1964. The petitioners may approach the Commissioner and seek further relief as may be permissible in law with regard to the impugned orders.

If the petitioners approach the Commissioner by filing appeal, considering the urgency of the matter, the Commissioner may consider the prayer of the petitioners for interim orders on its own merits after hearing the Zilla Parishad Chief Executive Officer, expeditiously and on priority basis.

6.

Depending on the order passed by the Commissioner, the petitioners may agitate their grievance before the respondents or may take up such appropriate proceedings as may be permissible in law, that may probably help them.

7.
