The applicant is seeking regular bail in Crime No. I-180 of 2015 registered with Akole Police Station, Taluka Akole, District Ahmednagar for an offence punishable under Sections 395, 342, 120-B, 412 of Indian Penal Code, pursuant to the incident occurred during the period from 15/12/2015 to 16/12/2015. 2.

The investigation in the matter is already over and charge sheet is filed.

There was earlier offence against the applicant, however,

-2he is acquitted in the same i.e. offence punishable under Section 395 of the Indian Penal Code.

It is to be noted that the applicant is not identified by any witness in identification parade.

In view of above, in my opinion, the applicant is entitled to be released on bail. Hence, the following order:- (i) The applicant be released on bail, in connection with Akole Police Station, Taluka Akole, District Ahmednagar for an offence punishable under Sections 395, 342, 120-B, 412 of Indian Penal Code, upon furnishing P.R. bond of Rs.15,000/- with one surety in the like amount.

(ii) The applicant shall not tamper with the prosecution evidence or influence the prosecution witnesses. (iii) The applicant shall attend the trial regularly and cooperate the Court below in disposal and shall not protract the same by seeking adjournments. If conditions above are not compiled, learned Sessions Judge will be at liberty to proceed ahead for cancellation of bail, if so desire.
