This is an Application for condonation of 1619 days delay in preferring the Criminal Appeal against Conviction recorded by the learned Special Judge, Beed, in Spl. (POCSO) Case No. 40/2016 by Judgment and Order dated 28.08.2019.

The learned Advocate for the Applicant submits that the Applicant is behind the bars and therefore the delay is caused and same needs to be condoned.

Learned APP for the State and the learned Advocate for the Respondent No. 2 opposed the Application. They submit that, no sufficient grounds are made in the Application and the same be rejected.

After hearing both the sides and considering the averments made in the Application, the Application is allowed in terms of prayer clause 'B'. The aforesaid delay is condoned. 5.

The Application stands disposed off.
