We have perused the contents of the First Information Report No.4 registered on 02.01.2024, with the Newasa Police Station, District Ahmednagar. We have also perused the affidavit filed by the 80 years old victim of grievous injuries, who is the biological father of Applicant No.1, grandfather of Applicant No.3 and father-in-law of Applicant No.2.

Considering the principles culled out in Narinder Singh vs. State of Punjab, (2014) 4 SCR 1012 : (2014) 6 SCC 466, we expressed our disinclination.

The learned Advocate for the Applicants submits, on instructions, that the Applicants desire to withdraw this Application.

In view of the above, this Criminal Application is dismissed as withdrawn, on instructions.

Insofar as the request for maintenance of the old Complainant, who is now more than 80 years old and his wife is close to 80 years, needless to state, the Complainant has a right under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
