...Respondents

Mr. S.S. Thombre, Advocate for Petitioners Mr. Y.G. Gujrathi, Assistant Government Pleader for Respondent Nos. 1 and 2 Mr. A.D. Aghav, Advocate for Respondent No. 3 CORAM : S. V. GANGAPURWALA AND A. M. DHAVALE, JJ.

DATE : 11th APRIL, 2019 ORAL ORDER:

1.

Mr. Thombre, the learned Counsel for the petitioners submits that the petitioners are the only working women in the family, though they are married, their husbands are not in any Government service or Zilla Parishad service. They are transferred at distance of about 70 to 80 Kms. from their original place of working and some of them have been transferred at interior places, so also hill areas.

2.

According to the learned Counsel, though the Policy has been framed by the Government with regard to the transfers under the Government Resolution dated 27.02.2017, no Policy is evolved

2 915-WP-6118-2018 to consider the cases of the teachers like petitioners. The Government is bound to formulate the Policy for the said purpose. 3.

We have heard the learned Counsel for the Zilla Parishad and the learned Assistant Government Pleader. 4.

It is more than one year, the petitioners are already transferred and they are working at the transferred place. The Government has issued a corrigendum, thereby putting a locking period of three years.

5.

It is only for the Government to consider the situation as is pointed out by the petitioners and to take decision as per its wisdom. The petitioners may approach the Government for redressal of their grievances viz. implementing the transfer Policy with regard to the cases of single women.

6.

In case the petitioners approach the Government, naturally, the Government shall consider the same on its own merits and in accordance with law.

7.

The Writ Petition is disposed of. No costs.
