Heard learned counsel for the applicant and learned APP for the State at length.

As per order dated 06.10.2022, the present applicant-accused Babu alias Baburao Gopal Kamble was released on temporary for the period of four months in connection with Crime No. 0033/2022 registered with Udgir Rural Police Station Dist. Latur. Thereafter on 24.02.2023, the said temporary bail was extended for a period of three months, which would expire on 24.05.2023.

The learned counsel appearing for the applicant submitted that 1/2

Appln1902-23 as on today, the applicant is admitted in Udaygiri Multispeciality and Accident Hospital, Udgir for treatment of Hernia and the applicant is likely to be discharged on 28.05.2023. The certificate issued by Udaygiri Mutispeciality and Accident Hospital, Udgir is taken on record and marked as Annexdure '

X' for identification. Therefore, considering the ailment of the applicant, the temporary bail is extended till 29th May, 2023 being last to last chance.

If the applicant fails to surrender before the jail authority on or before 29th May, 2023, his custody would be taken as per law. 5.

It is made clear that if the accused is surrendered, he would be at liberty to file application for regular bail before the trial court, which may be decided as early as possible.

Criminal application is disposed of.
