As there is delay of 63 days in filing the appeal, present application is filed for condonation of delay.

None present for the respondents, though served. 3.

Delay is sufficiently explained in paragraphs 3 to 6 of the application. Hence, the delay of 63 days caused in filing the appeal is condoned.

The appeal be registered. Upon registration, issue notice to respondents. Mr.S.R.Bagal, learned counsel waives notice for respondent no.1. Parties are put to notice that the matter might be heard finally at the stage of admission, since the only involved therein is as regards quantum and enhancement. 5.

Office objections, if any, be removed within two weeks, failing which registration of the appeal shall stand cancelled. 7.

The matter be listed after service of notice is complete. In the meantime, applicant/appellants shall take recourse to Chapter II of the Bombay High Court Appellate Side Rules, 1960, corresponding to the position of the matter.
