The petitioner has filed the present petition assailing order dated 18.04.2022 passed by the learned Labour Court, Jalna in MCA No. 01 of 2021 to the extent of depositing of amount of Rs. 3,54,708/- as pre condition for setting aside the order passed for proceeding ex-parte.

The order is challenged only on the ground that on account of Pandemic situation prevailing in the Country the Labour Court ought not to have passed the order proceeding ex-parte against the petitioner.

The Labour Court already set aside the ex-parte order and granted liberty to the petitioner to submit his reply/written statement. The only condition that is imposed is to deposit 20%

7wp8835.22 amount of compensation.

I do not find that the Labour Court has committed any error in directing the petitioner to deposit 20% of awarded amount of compensation as pre condition for setting aside the order to proceed ex-parte. I do not find any merit in the present petition. 5.

Mr. Suryawanshi, learned Counsel for the petitioner prays for extension of time for depositing amount of Rs. 3,54,708/-. 6.

Let the amount be deposited within a period of two months from today.
