In W.P.No.7007/2011 vide order dated 22.8.2014, has already observed about cut-off date to be discriminatory. In the present matter as per submission of the learned counsel for petitioners even bills were prepared regarding the assured time bound progressive scheme as per Government Resolution dated 1.4.2010. They were sent to the Treasury also but because of the subsequent explanation dated 1.7.2011, the same are withheld. 3.

In light of the order dated 22.8.2014, in W.P.No.7007/2011, it is held that the petitioners are entitled for the benefit of Government Resolution dated 1.4.2010 and the explanation dated 1.7.2011 does not hold good. The Respondent-State shall after

satisfying themselves of the date of the retirement of the petitioners shall consider and make payment accordingly.

The Writ Petition is disposed of. No costs.
