Pradip Dilip Sakat v. The State Of Maharashtra Through Its Principal Secretary And Others
- 1 -
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.6795 OF 2022 PRADIP DILIP SAKAT
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND OTHERS Mr.S.K.Tambe, AGP for respondent/State.
( CORAM : RAVINDRA V. GHUGE AND ARUN R. PEDNEKER, JJ.) DATE : JULY 26, 2022 PER COURT :
1.
On 05.07.2022, we had passed the following order :- "None for the petitioner.
Stand over to 26th July, 2022, for passing orders." 2.
Even today, though the petition is listed under the caption of "passing orders", none appears for the petitioner. 3.
The petitioner has put forth prayer clause '
B'
as under :- "B. Be pleased to kindly direct respondent No.3 to decide the application/representation dated 14.06.2021 preferred by the khs/July 2022/6795
- 2 - petitioner alongwith the other applicants therein for regularizing service and to conform on regular pay scale as per prayed in the said application/representation."
4.
The learned AGP vehemently submits that this petition is without merit. The petitioner was a contractual employee. There is no vested right for seeking continuation or regularization. A contractual employee cannot be foisted on any establishment. 5.
In view of the above, since the representation dated 14.06.2021 presented by the petitioner is pending with respondent No.3, this petition is disposed off with the expectation that respondent No.3 would respond to the said representation and convey the views of the Department to the petitioner, on or before 30.09.2022. We make it clear that we have not expressed any opinion about the contentions of the petitioner in the representation.
