Heard Advocate Shri Rahate and A.P.P. for State. Perused developments in this proceeding and the order dated 4th May 2016. The reasons given in

the Application have no substance. However, if costs of Rs.5000/- (Rupees Five Thousand) are deposited in this Court, further orders regarding cancellation of non bailable warrant would be passed.

It is stated by the learned counsel for the Applicant-accused that costs have been deposited and that non-bailable warrant is yet not executed. If the same is yet not executed, the same shall be returned by the concerned police officer without executing the same. The nonbailable warrant stands withdrawn and cancelled, if it is yet not executed. If it is by chance executed in the meanwhile, the accused be released on existing bail. Hamdast of cancellation of the non-bailable warrant be handed over to the counsel

for the Appellant-original accused for the accused to submit the same to the concerned Police Station.

List the Appeal for hearing finally on 28th June 2016.

The Criminal Application stands disposed of, accordingly.
