Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.30 of 2024 registered with Ausa Police Station, District Latur for the offence punishable under Sections 302, 323, 182 r/w 34 of the Indian Penal Code.

The deceased was the younger brother of the applicant. He was addicted to liquor. The FIR reveals that the deceased was harassing his mother for drinking liquor. The facts of the case reveal that in the fit of anger and regular harassment at the hands of the accused to the mother, the incident took place. It was pretended to be suicide. But the truth was unearthed. The peculiar circumstances in which the offence happened are to be considered in this case. The

967-ba-930-2024.odt (2) relevant incriminating material has been recovered from him. At the cost of repetition, the circumstances of this case were specific. Therefore, this Court exercise the discretion under Section 439 of the Criminal Procedure Code granting the applicant bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Sachin Balaji Jadhav, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the trial on each and every date.
