CORAM: S.G. MEHARE, J.

DATE : 30th JULY, 2024 ORDER :

1.

Heard learned counsel for the applicant, learned APP for the State and learned counsel for the informant. 2.

This is a successive bail application of the applicant in Crime No. 0141 of 2023 registered with Karjat Police Station, Taluka-Karjat, District-Ahmednagar for the offence punishable under Section 307, 143, 147, 148, 149 of the Indian Penal Code and under Sections 3/25, 4/25 of the Arms Act. 3.

Earlier bail application of the applicant was rejected by this Court on 24th July 2024, after considering the charge-sheet and

ba-935.24 the arguments advanced on all the grounds. The order of this Court has also been confirmed by the Hon'ble Supreme Court. Now, the learned counsel for the applicant reopened the arguments which probably he had advanced earlier. Further, another ground for bail he has tried to raise is that there is no progress in the trial. Nowadays, this is very favourite ground for the accused to seek the bail though for many reasons the trials are protracted. Most of the time the trials are protracted as the co-accused who has been granted bail, remains absent. However, the learned APP would submit that the trial of the applicant has been separated and it is likely to be commenced within a short time. The applicant is not incarcerated in the jail for a long period. The Court has already held that the offence is serious. There was material against the applicant. There is absolutely no change in the circumstances.

4.

The application is devoid of substance, hence stands dismissed.

5. Criminal Application No.2880 of 2024 stands disposed of. [ S.G. MEHARE, J. ] asb/JULY24
